The environmental impacts proportionated or intensified by the human action had contributed to the insertion of the ecological thematic in the collective thought and legal feeling. According to all these aspects, throughout the last decades, the environmental prerogativeshave been increased and introduced on constitutional basis of Democratic States, doubtlessly important to the guardianship of ecological and landscape patrimonies. An analysis of the emergence and consolidation process of the Environmental Protective State in the Brazilian and Portuguese legal systems took place, oriented by constitutional and comparative studies of its principles.Downloads
