Good adventures in Pasagarda of legal pluralism or some alternatives for a postmodern science of law?

Abstract

This paper rescues the scientific investigation about legal pluralism conducted by Boaventura de Sousa Santos in Jacarezinho, int the Rio de Janeiro city, a Brazilian favela, in the year of 1970. The context of “Pasargada law” birth and development is commented and the normative mechanisms and legal forums created by the community are tied with the collective fight in favor of the right to housing. Additionally, the main characteristics of the local legal process are described. Finally, two questionings are formulated, about the possibilities and limits of the insurgent law – as it was visualized, in the past, by the Portuguese jurist and sociologist – considering the current challenges.
