The collision of the rights to the honor, the privacy, the private life and the image versus the information and freedom of speech

The great technological advance allowed that the information reached an entire planet, implying growth for society. However the excess of information offered to the world made that the responsible medias for divulging the news also contributed for publication of the true information and the untrue one, causing immensurable damages. The citizen has been both addressees of the information but also started being a hostage of these ones because the free declared press for the Brazilian Constitution of 1988, sometimes invades the rights of the personality of the individual. Thus, the present article has the target to analyze the existing constitutional conflict among the press freedom (arts. 5º, incorporation. IX and 220 § 1º and 2º) and the rights of the personality (art. 5º, incorporation. X). However it is distinguished the collision among these rights, the relevance of the basic rights in our legal system and the solutions ahead of their friction and which one is the most adjusted.Downloads
