Analysis of the legal reserve institute and the current degradation scenario

Abstract

This wok aims to evaluate the institute of Legal Reserve, established by Forestry Code- Law No. 4771/65, which impose the necessity of be maintained 20% to 80% of native forests or other kinds of vegetation in rural areas. The purposes of the Legal Reserve are preserve the good conditions of the land and propitiate an ecologically balanced environment. Also are going to be analyzed some mechanism of adaptation and making flexible, such as natural recovery or compensation, established to give the opportunity to owner or holder of comply with the law. However, the regulations protecting the Legal Reserve have been inefficient, as it has a chronic noncompliance with the rule. There are many numerical data proving this fact. The purpose of the present work is to analyze the Legal Reserve and its mechanisms, as well as the reasons for the noncompliance scenery.
