Abstract

The 2002 Civil Code, under the orientation of the illustrious Minister of the Federal Superior Court, Jos. Carlos Moreira Alves, and mirrored in German, Portuguese and Italian legal diplomas, reserved a chapter in its general part for the representation institute. While revising the chapter concerning the Insurance Contract, the eminent jurist and professor F.bio Konder Comparato stipulated a legal representation while developing an article concerning the coinsurance modality. This essay analyzes the limits and reach of the Coinsurance representation, in the plans of the material law and procedural law.
