Abstract

The model generated by globalization in the last decades, promotes important changes in social interactions, fomenting discussions about the position of vulnerability of the consumer in the private contracts of health plan, object of the investigation. From a critical analysis, through the deductive method and bibliographical survey, the study analyzes the assumptions that mark the constitutionalisation of business relations, with a view to an adequate regulation to the tutelage of the weak part, plus the methodical of the essentiality paradigm.
