The article aims at human and objective investigating whether human rights should be understood as positivized rights or as the result of social rights practices. The first chapter is conceptually delimited framework of the investigation of human rights. In the second, addressed the possibility of considering human rights as rights internationally positivized. In the third, it has envisaged considers human rights as the theoretical result of concrete social practices.
