Abstract

The optional civil liability insurance for vehicles is contracted so that the victims of damages in traffic accidents caused by the fault of the insured can be compensated. The proven state of drunkenness is treated as an exclusion of liability in private insurance contracts, but the Superior Court of Justice understands that the victim cannot be harmed, under penalty of not fulfilling the social function of the insurance contract. This work uses a bibliographic research methodology with a review of articles and legal books and an analysis of decisions of the Superior Court of Justice in the light of the general clauses of good faith and social function of contracts and the achievement of the constitutional objectives of building a free society, fair and solidary. The objective is to build a reflection that answers the question: does civil liability coverage when considering drunkenness as a covered risk contribute to the achievement of the constitutional objectives of a fair and solidary society?
