Abstract

The objective of this text is to reflect about the evolution of human rights as well as to discuss it including the concept and the actual understanding had of it. It is defended that the natural right overlaps the one known as positive right, understanding that the right to life is an universal right to be defended in any context. Although it is defined by the Universal Declaration of Human Rights, of the Modern Age, it is an old concept and it was fed by the previous ideas from Rousseau, Montesquieu and others. It is discussed the born of the Declaration of Human Rights and it’s break in the Brazilian scene, looking for an understanding of the ways to which it points.
