After a long time of oppression propagated during absolutism, the State assumed the duty to punish the delinquents, implementing criteria of justice for all, whose observance is obligatory and independent of the existence of media oppression. Truth be told: we live in a delicate moment in which discourses are increasingly inflated in order to arouse anger, anger, and antipathy in those who are unaware of the origins of criminological problems. It is no surplus to say that in the media criminal process the magistrate becomes hostage to punitive and oppressive media. It is important to emphasize that respect for the fundamental guarantees of the accused is not confused with impunity. Criminal proceedings can not be considered as an instrument in the service of the State's ius puniendi, but as a limiting factor of this power and guarantor of the rights of the individual subjected to it.
