The "post-positivism" as a built on understanding reductionist concept about legal positivism

This paper seeks to answer the following question: the use of postpositivism expression involves ordinarily a mistaken and reductionist characterization of legal positivism? We will see that the answer is yes and that positivism has not been overcome, but transformed by developments that have made a theoretical field that is not the same as the first half of the twentieth century. The present research is justified by the need to deepen this topic of great complexity and to promote this exchange of knowledge. The scientific research is directly related to the determination of the methods of study. In view of its theoretical character, material will be used predominantly bibliographical, with extensive bibliographical research in monographs, theses and scientific articles, in order to collect the most relevant information about the topic raised.Downloads
