Creation of new rights, affectivity and politics: first considerations

Abstract

The objective of this article is to explore the affective dimension which is central to the political demands that aim to create new rights. The research brings out some conceptions of affect in order to explore its multiple dynamics that revolve political demands and the self-understanding of social actors related its own necessities and rights. In this perspective, theorizing the affects is relevant to clarify irrational dimensions of the social practices and legal constructions, expanding or constraining social actor´s rights. This article intends to avoid restricting a demand that involves the creation of new rights to a strictly rational understanding of the legal actors in order to stress the relevance of the imaginary and the affects in legal and political practices.
