Criação de novos direitos, afetividade e política: incursões iniciais

O objetivo deste artigo reside em explorar a dimensão afetiva que envolve as demandas políticas que pressionam a criação de novos direitos. Para tanto, a pesquisa traz à tona algumas concepções de afeto com o propósito de apontar as suas dinâmicas na promoção das demandas políticas e na autocompreensão dos atores sociais em torno das suas próprias necessidades e direitos. Teorizar os afetos, neste contexto, mostra-se pertinente para se esclarecer os aspectos irracionais da prática social e da construção jurídica, que expandem ou limitam as prerrogativas jurídicas dos atores sociais. O artigo pretende evitar reduzir a demanda por novos direitos a uma compreensão estritamente racional dos atores jurídicos, enfatizando, deste modo, o papel do imaginário e dos afetos nas práticas jurídico-políticas.
