Right to the territory and multiculturalism

Abstract

Is approached through this article, the modern state's attempt to reconcile the individual with the collective perspective. This discourse necessarily involves the approach of the legal-dogmatic view of multiculturalism, with the exponent pragmatic right to the territory. Access to the right, however, has not been quiet, the target of tensions. As a result, we seek to address in this study, as the right to the territory has been seen at both the normative and jurisprudential level.
