Ideology, judicial decision and social human rights: an re 590.415’s analysis

The aim of this research is to understand a presence of ideological stance, especially the neoliberal, in the judicial decision in the labor law. To this end, employ’s dialectical hemeneutical method for study how the concept of ideology was made, and also on how it can be reflected in judicial decisions, especially when it is shown that its content is much more political-ideological than legal. In this regard, Extraordinary Appeal (RE) No 590.415 of the Federal Supreme Court had an essential role as a privileged example, from which the analyzes were carried out applying the concepts defined and delimited throughout this article.
