Abstract

Work is an umbilically linked activity with all spheres of a person's life, since a significant part of the human being's working life is reflected in the personal, family, and social dimensions of the worker. In such a way, a healthy working environment is crucial for the good development of the person, in all said dimensions. It is for no other reason that social rights are erected to human rights status. The objective of this essay is precisely to verify the normative juridical contours that allow the subsumption of conduct as a form of moral harassment, and in these terms, the legal consequence of said practice. The on-screen research, using a methodology of qualitative analysis, using the hypothetical-deductive approaches of a descriptive and analytical character, adopting a bibliographic research technique, has as its background a dogmatic analysis of the construction Normative of the conduct of moral harassment in the bulge of the Brazilian juridical system having by axiological vector, always, the search of the effectiveness of the fundamental rights carved in the Federal Constitution of 1988.

rocco antonio rangel rosso Nelson, Instituto Federal do Rio Grande do Norte - IFRN

Graduou-se em direito pela Universidade Potiguar (2004). Especializou-se em Ministério Público, Direito e Cidadania pela Fundação Escola Superior do Ministério Público do Rio Grande do Norte (2007), bem como na área de Direito Penal e Criminologia pela Universidade Potiguar (2007). Mestre em Direito Constitucional pela Universidade Federal do Rio Grande do Norte (2009). Foi professor da Faculdade de Ciências Cultura e Extensão do Rio Grande do Norte - FACEX, por um período de 5 anos, tendo lecionados as cátedras de Direito Penal - I, Direito Penal II, Direito Penal III, Direito Penal IV, Direito Processual Penal - I e Direito Processual Penal - II, Direito Processual Constitucional, Direito Tributário, Direito Empresarial, Direito Administrativo, Direito da Seguridade Social. Lecionou nas pós-graduações "lato sensu" em MBA em Gestão Pública, MBA em Gestão Financeira, MBA em Auditoria e Perícia Contábil, em Elaboração e Gerenciamento de Projetos e em Assistência Sócio-jurídica e Segurança Pública. Já ministrou aulas na faculdade Estácio de Sá e na Universidade Federal do Rio Grande do Norte - UFRN. Atualmente, professor efetivo de Direito, no Instituto Federal do Rio Grande do Norte - IFRN, articulista, poeta e escritor. É autor do livro: Curso de Direito Penal - Teoria Geral do Crime (1º ed., Curitiba: Juruá, 2016)
