This article sought to examine whether Laws nºs. 7881/2014 and 215/2015 carry illegitimate restrictions on freedom of expression, analyzing whether the exercise of the right to be forgotten implies censorship. The material bases of the right to be forgotten and freedom of expression on the internet were presented, identifying a theoretical model capable of indicating in an appropriate way the restrictions on freedom of expression when in collision with other fundamental rights. It was concluded that laws that may be edited due to possible approval of laws nºs. 7881/2014 and 215/2015 will be unconstitutional, since they will establish undue restrictions on freedom of expression.Downloads
