The children and adolescents legal protection and its normative source

Abstract

This article aims to emphasize that, in order to reach social justice as one of the objectives of the Democratic State of Law, it is indispensable the promotion and the guarantee of universal human rights with the recognition of peculiarities of certain subjects, among them: children and adolescents. The recognition of children and adolescents peculiarities allows considering them as specific subjects of rights and has already been established in several national and international statutes, not only in specific and directly instruments designated for those subjects, like the Child and Adolescent Statute. Thus, to assure the accomplishment of these rights, it is necessary to observe the legal system as a whole. This is what the present study intents to demonstrate, emphasizing, without the pretension of exhausting the discussion, the children and adolescents main rights in several internal and international legal instruments.
