Jurist language in front of juridical and cultural representation of traditional folks and communities: the case of possessory conflict involving the quilombola community of São Bento, Brejo/MA/BRA

Abstract

This article inserts into the juridical conflicts context involving traditional folks and communities territory. Want to comprehend the distance between the representation from the jurist language and those from the traditional folks and communities relationship. For this, approach the consolidation of the jurist language legitimacy, the imposition of conformation of traditional peoples and communities to that language, in the end, the case of possessory conflict involving the quilombola communitie of São Bento, Brejo/MA/BRA. The theoretical framework used goes from the jusrealist and antiformalist concept of Santoro about the Right, inserting in the Bourdieu studies about State and the juridical field. As for the methodology, used documental, bibliographic end field research, with study of the São Bento community case.
